1、享有参加业务(技术)学习(培训)、参加工会、参与民主管理和提出合理化建议、评选和被评选为先进职工(生产者)等权利;
2、按照规定领取劳动报酬和享受劳动保险福利待遇;
3、享有休息、休假与获得劳动安全卫生保护的权利。对违章指挥、强令冒险作业,有权拒绝执行;
4、按照有关规定及本合同的有关条款,可以解除劳动合同;
5、甲方不履行本合同时,乙方有权依法向劳动争议仲裁委员会提起申诉;

1、服从甲方的生产组织管理,尽职尽责,努力完成生产(工作)任务;
2、遵守国家法律、法规和社会公德,保守国家秘密、甲方商业秘密,爱护甲方财物;
3、遵守厂纪厂规和劳动纪律,执行生产操作规程和劳动安全卫生规程,讲究职业道德;
4、努力学习政治文化知识,刻苦钻研技术,不断提高专业技术水平,积极参加必要的
社会活动;从事技术工种或岗位的,上岗前必须接受培训;

四、工作时间与劳动报酬
(一)甲方根据国家法律、法规和本单位生产(工作)实际,实行 工作制。甲方对乙方实行每日工作时间 小时,平均每周工作时间 小时的工时制度

五、社会保险和福利

3、由于不可抗拒力致使本合同无法履行的;

(二)在下列情况下,甲方可以解除劳动合同
1、在试用期内证明乙方不符合录用条件的;
2、乙方违反或不履行劳动合同的;
3、乙方严重失职,营私舞弊,对甲方利益造成重大损害的;
4、乙方严重违反劳动纪律或甲方规章制度,泄漏甲方商业秘密的;
5、乙方被依法追究刑事责任的;
6、乙方患病或者非因工负伤,医疗期满后不能从事原工作,也不能从事由甲
方另行安排的工作的;
7、乙方不能胜任工作,经过培训或者调整工作岗位,仍不能胜任工作的;
8、劳动合同订立时所依据的客观情况发生重大变化,致使原劳动合同无法履行,经甲、乙双方协商不能就变更劳动合同达成协议的;
9、经有关部门确认,甲方歇业或合营、合资期满关闭,宣告破产或者濒临破产处于法定整顿期间的;依照第6、7、8、9条解除劳动合同的,甲方应提前三十日
以书面形式通知乙方并支付经济补偿金。

(三)在下列情况下,甲方不得解除劳动合同
1、劳动合同期未满,又不符合上款解除合同条件的;

4、甲方劳动安全、卫生条件恶劣,严重危害劳动者身体健康的;
5、甲方有侵害乙方合法权益行为的;
6、经甲方同意,乙方自费离职学习和培训的;
7、乙方参军、入学或出境定居的:

The second party's rights
A. Enjoy the rights to participate in business (technical) learning (training), join trade unions, and to participate in the democratic
management and put forward reasonable suggestions, selection and been voted to be the advanced worker (producers), and other rights

4. Working hours and labour remuneration
The first party adopts ___duty, according to the national laws, regulations and this unit production (work) reality. The first party
adopts the working system ____hours per day, ___hours per week for the second party. If the first party need the second party to work
overtime, the first party should pay overtime or leave and the overtime should not exceed 1 hour per day, 36 hours per month by

Labour remunerations
A. If the second party complete the regulated production task of this contract, the first party should pay salary to the second party with

6. Labor contract's changes, the renewal, removal and termination

commercial secrets.
E. The second party is investigated for criminal liabilities according to law.
6. The second party is sick or not be injured at work,and cannot be engaged other work by the firat party after the expiration of the
medical treatment.
7. The second party can not be qualified for th job, or still not qualified for the job after training or job adjustment.
8. The objective circumstances has changed which was the base of the labour contract. So that the contract can not fulfilled, and it can
not reach an agreement after consultation by both sides.
9. Confirmed by the relevant departments, party a go out of business or joint venture, the joint venture expires closed, declares

E. The second party are enjoying the legal holiday or in the family visit.
F. Other situations regulated by the laws and regulations.

(四) The second party can remove the labour contract under the following situations.
A. During the probation
B. The first party compel labour with the methods of violence, threat or illegal restriction of personal freedom

D. The first party owns bad condition of the labour safety and the health condition, and hurt the employees' health badly.
E. The first party's performance has hurt the legal benefits of the second party.

G. The second party join the army, entrance or go abroad to settle.
H. Other situations appointed by both sides

A. Accept training (including send large, secondary technical schools or vestibule school learning) capital contributed by the first
party, and service for the first party under____years after training.
